Terms and Conditions 

• It is understood that Lynn Tucker Creative is the exclusive photographer retained to perform the photographic services requested on this contract. Therefore, no film or cameras, cell phone cameras or recorders may be used during our session.
• In the event of a cancelled appointment, Lynn Tucker Creative will attempt to fully replace your cancelled reservation.  If I am unable to do so, a $50 preparation/office fee will be deducted for reasons other than inclement weather. 
• If inclement weather or adverse conditions prevent a portrait session meeting the artistic standards of the photographer, the photographer may elect to use an alternate location or to reschedule the portrait appointment.  
• If Lynn Tucker Creative cannot perform this contract due to casualty, strikes, act of God, emergency, or other causes beyond the control of the parties, the photographer will return any deposit-sitting fee to the Client but shall have no other liability with respect to this contract. The limitation and liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault of the Photographer. In the event the photographer fails to perform for any other reason, Lynn Tucker Creative shall not be liable for any amount of excess of all monies paid.
• Your session fee covers the time, talent, intellectual properties and any props of the photographer. It secures the current pricing. The session includes a $50 credit toward purchases and five digital files.  
• If the client is late to the scheduled portrait session, that time will be forfeited.  The photographer can not stay over the allotted time period.  If the client does not show up for the scheduled portrait session, they will still be charged in full for the photographer's time. The photographer will remain at the location for the entire allotted session time in the event the client does arrive and during that time will attempt to contact the client.  
• No part of any order, including previews, will be delivered until your balance is paid in full.  The standard pricelist of Lynn Tucker Creative is adjusted periodically.  With this contract, this session and one order from it will be priced according to the contract date below.  Future orders shall be charged at the price in effect at the time the order is placed. 
• Lynn Tucker Creative will attempt store your purchased portraits on an external hard drive for one year. However, in the event of failed technology, I can not guarantee replacement of your images.  Please purchase prints as your guarantee.
• Lynn Tucker Creative reserves the right to use images created under this contract for advertising, display, and publication, such as but not limited to, electronic media and commercial art at no cost. The client signing this contract warrants that he or she has actual authority to agree to the likeness of all persons included in the portrait in this manner and shall waive any and all rights to review or approve any use of images, written copy or finished product. Negatives, digital files and previews remain the exclusive property of Lynn Tucker Creative.  Any posted online will always be marked with a logo to represent Lynn Tucker Creative and remain the intellectual property of Lynn Tucker Creative.  
• Notice of Copyright: All photography by Lynn Tucker Creative and/or Lynn Tucker is protected from copying, scanning, reproduction, enhancement or manipulation by US Federal Copyright Law. It is illegal to reproduce without the written permission of Lynn Tucker Creative. By signing this contract, you are agreeing not to copy, save, or reproduce images in any way. This includes copying and saving images from the website, blog, Facebook, or any other form of advertisement.  All photographs from this session remain the intellectual property of Lynn Tucker Creative.  The contract incorporated the entire understanding of the parties and is governed by the laws of Saint Charles, Kane County, Illinois.  Any modifications of this contract must bemade in writing and signed by both parties.
